Article 1: Purpose and Scope

    These Terms and Conditions set out the terms and conditions of use for the use of the online store (hereinafter referred to as the "Service") provided by Crélia Japan LLC (hereinafter referred to as the "Company") on the Website (crelia-japan.com) by the customer using the Service (hereinafter referred to as the "User"). These Terms and Conditions shall apply to all matters relating to the use of the Service between the User and the Company. In addition, with regard to other services provided by the Company to promote the use of the Service, the respective Terms of Use shall apply in conjunction with these Terms of Use.

Article 2: Users

  • In the Service, User is the generic term for the Orderer and Guest User, and refers to any legal entity, organisation or individual who is entitled to use the Service in accordance with the procedures set out by the Company.
  • The Orderer is a user who, having agreed to these Terms and Conditions, orders a product in accordance with the procedures stipulated by the Company and whose order is accepted by the Company and a purchase contract is concluded.
  • The Guest User is a user who uses the Website, such as browsing, without having completed the purchase procedures set out in the preceding paragraph. This also includes those who access the Service by mechanical means, such as crawlers. Guest Users may use the Site free of charge, but the Guest User shall be responsible for equipping the necessary communication equipment and procedures for doing so at his/her own risk and expense.
  • In the event of any of the following, the Company may, at its discretion, not approve the purchase of goods by the ordering party, restrict the use of the Service or cancel the order of the ordering party who has already approved the purchase of goods, and refuse all further use of the Service. The Company shall not be liable for any damage incurred by the Orderer or any third party as a result of this.

Article 3: Purchase and Fees

  • A person wishing to purchase a product shall place an order for the product after entering the necessary information on the Website and agreeing to these Terms and Conditions.
  • The Company reserves the right to reject the order at its own discretion. Even if the Company rejects an order, the Company shall not be held liable to the orderer for the rejection, nor shall the Company be obligated to disclose the reason for the rejection to the orderer.
  • A contract for use of the contents of these terms shall be concluded between the purchaser and the Company at the time the orderer completes the order for the product.
  • The orderer shall bear any fees incurred at the time of payment, such as bank transfer fees.
  • Fees shall be paid in advance.
  • The Company will not issue receipts upon payment of fees, and remittance request records issued by financial institutions will serve as receipts.

Article 4: Prohibitions

    The User shall not perform any of the acts set out in the following paragraphs when using the Service.
  • Any acts that infringe or may infringe the intellectual property or other rights of the Company, other Users, third parties, or the Service.
  • Any acts that infringe or may infringe the property or privacy of the Company, other Users, third parties, or the Service.
  • Any acts that cause disadvantage or damage to the Company, other Users, third parties, or the Service, or acts that may cause such disadvantage or damage.
  • Any acts that resell, lend, or transfer products to third parties.
  • Any acts that are criminal or that are linked to criminal activities, or acts that may cause such disadvantage or damage.

Article 5: Suspension and Stop of Service

  • Regardless of the reason, the Company shall not be liable for any damages suffered by the User due to the interruption or suspension of the Service.

Article 6: Identity Confirmation

  • The Company may request the Orderer to present his/her address, name, telephone number and identity documents in order to confirm the authenticity of the contents of enquiries, etc., falling under Article 12.1. The Orderer shall present accurate information to the Company.

Article 7: Privacy Policy

  • The Company will obtain the minimum information required to provide the Service from the User. The Company will respect the User's privacy and will handle the User's privacy information appropriately in accordance with the Privacy Policy. For details, please refer to the Privacy Policy.

Article 8: Contact Method

  • If you need to contact the Company regarding the Service, please contact us using the "Contact Us" form on this site. The Company may refuse to respond to any other contact methods. The Company will contact the User regarding the Service by email, posting in an appropriate place on this site, or by any other method that the Company deems appropriate.

Article 9: Addition, modification, and change of terms

  • The Company may add, modify, or change these terms without the prior consent of the User, regardless of the reason. Such modifications shall be announced to the User each time through the means provided by the Company.

Article 10: Management of email addresses

  • The User shall correctly maintain the registered email address information so that emails from the Company can be received. If the User is unable to receive emails from the Company for any reason, the User shall promptly and appropriately change the registered email address. The User shall be responsible for any disadvantage due to being unable to receive emails from the Company, and the Company shall not be held liable in any way.
  • The Company shall have the right to modify or delete the User's information for the purpose of maintaining, improving, and facilitating the smooth operation of the Service.

Article 11: Non-disclosure of information

  • The Company shall not disclose to a third party any personal information registered by the User when using the Service without the User's permission. However, this shall not apply in the event of a request from the police or other relevant authorities.
  • The User may obtain the User's personal information held by the Company at any time by making a request for disclosure to the Company by the User.

Article 12: Refunds and Cancellation of Purchases, etc.

  • The User may cancel an order at any time by following the procedure below.
    • Submit a request to cancel the order via the "Contact Us" form.
  • If the User falls under any of the following items, the Company may cancel the order of the User without prior notice to the User. In such cases, the Company shall not be held legally liable for damages or other damages to the User.

    • In any other case where the Company deems the User to be unsuitable as an orderer.
  • Due to the nature of the products, no returns or refunds are possible after the product has been sent or downloaded.
  • If an order is cancelled, the Company shall not in principle accept a refund of the price already paid, except before the product has been sent or downloaded, and the Company may collect the price already paid as a penalty charge.

Article 13: Disclaimer

  • The Company shall not be liable for any and all damages arising from the use or non-use of the Service by the User, irrespective of any direct or indirect reason.
  • No guarantee is made as to the suitability of the information and functions provided by the Service for the User's specific purposes, or as to the completeness, accuracy, certainty or usefulness of the content and other information delivered.
  • In the event that the User causes damage to another user or a third party, or the User has a dispute with another user or a third party in connection with the use of the Service, the Company shall not assume any liability whatsoever and the User shall compensate for such damage and resolve such dispute at his/her own expense and responsibility. The User shall compensate for such damage at the User's own cost and responsibility, resolve such disputes and shall not cause any inconvenience or damage to the Company.
  • The Company shall not be obliged to provide support for the equipment and software used by the User or to set up or modify the equipment and software managed by the Company in order to enable the User to use the Service.
  • The Company may change the content or specifications of the Service, or suspend or discontinue its provision, without prior notice to the User.
  • The Company shall not be liable for the provision, delay, modification, suspension or discontinuation of the Website, loss or disappearance of information, etc. registered or provided through the Website, or any other damage incurred by the User in connection with the Website.
  • The Company will do its utmost to protect personal information, but will not be held responsible for any damage to the User caused by the abstraction of information due to unexpected unauthorised access or other acts.
  • In the event that the Company incurs costs or pays compensation in connection with a claim caused by the User's conduct, the User shall bear the costs (including legal fees) and compensation paid by the Company.
  • The date of delivery of goods may be delayed or varied due to holidays, New Year holidays, summer holidays, etc. designated by the Company, or due to emergencies (Article 5.1).
  • These Terms and Conditions were established in Japanese. In the event of any inconsistency between the Japanese and other languages due to translation, the content of the original Japanese text shall prevail. Any dispute arising out of these Terms of Use shall be resolved in the Japanese language.

Article 14: Jurisdiction

    The court with jurisdiction over the location of our head office shall be the court with jurisdiction over any disputes arising from the use of the Service.

Article 15: Governing Law

    These Terms shall be governed by the laws and regulations of Japan.
